Drafting practice and dispute practice are different skills
A lawyer who is excellent in court is not automatically the right person to draft your vendor agreements, and vice versa. Ask which of the two the consultant does most of, and match it to what you actually need this year.
Agree the fee structure in writing
Hourly, fixed-fee per document, or retainer — each is reasonable, and each suits a different pattern of work. What is not reasonable is starting work without a written scope. Ambiguity about fees is the most common source of friction in legal engagements.
Responsiveness is a legal risk factor
Notices have deadlines. A consultant who takes a week to respond is a genuine business risk, regardless of technical brilliance. Ask what the normal response time is and who covers when the primary contact is unavailable.
Build the compliance calendar early
Most penalties businesses pay are for missed filings, not for losing arguments. A consultant worth retaining will build a compliance calendar in the first month and remind you against it.
